EEOC Announces Opening of Collection of EEO-1 Data for Certain Private Sector Employees

On April 12, 2022, the U.S. Equal Employment Opportunity Commission (EEOC) announced the opening for certain private sector employers to submit required demographic information to the EEOC for 2021.

In general, all private-sector employers with 100 or more employees are required to file an annual EEO-1 report. Federal contractors with 50 or more employees and contracts with the federal government in excess of $50,000 are also required to file an EEO-1 form. The EEO-1 report identifies, among other things, the number of all full- and part-time employees employed during the applicable year and those employees’ sex and race/ethnicity. Employers are required to submit this information for 2021. The deadline to submit and certify the required 2021 information for private sector employers is May 17, 2022.

Employers required to submit this information can do so at www.eeocdata.org/eeo1.

If you have any questions about the reporting requirements, please feel free to contact Kemp Smith’s Labor and Employment Department at 915-533-4424
