As a partner in the firm's Labor and Employment Department, Mike McQueen's practice primarily consists of defending employers in employment-related litigation and providing counseling to avoid such lawsuits. He has been Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization for 25 years. Mr. McQueen has successfully represented clients to verdict before the State and Federal courts in Texas, the Federal District Court in New Mexico, and various federal and administrative agencies in El Paso, Austin, Santa Fe and the Southwest region. He has represented employers in union organizing campaigns and defending against unfair labor practice charges before the National Labor Relations Board, Regions 16 and 28. He has also represented clients in proceedings under the Occupational Safety & Health Act.
Over the past two years, Mike has had arbitration victories in a sexual harassment case for a local restaurant, an age discrimination and retaliation case against a local automobile dealership and an age discrimination case against a local governmental authority, and, in the union context, in a case involving seven employees of a government contractor who were involuntarily placed on medical leave instead of light duty. He also obtained a defense verdict in an age discrimination case in state district court and summary judgment in a discrimination/retaliation case in federal court.
Mr. McQueen served as the Chair of the Labor and Employment Law Section of the State Bar of Texas in 2002-2003, and has spoken numerous times at the State Bar of Texas Advanced Labor and Employment Law course and on several occasions at the State Bar's Advanced Civil Trial course. He has also been a guest lecturer on employment law issues at the University of Texas at El Paso Center for Professional Development and for the UTEP Franchise Center program. Mike was named Outstanding Young Lawyer of El Paso in 1983; in February 2001, he was featured as one of the 16 "Go To" labor and employment lawyers in the State of Texas by Texas Lawyer; he has been selected for inclusion in Texas “Super Lawyers” by publisher Thomson Reuters for Employment Litigation Defense every year since 2003, and he is listed in the Labor and Employment Law section of Best Lawyers in America. He was selected as Best Lawyers' 2014-2021 and El Paso Litigation - Labor and Employment Lawyer of the Year in 2019 and El Paso Employment Law - Management Lawyer of the Year in 2020 and 2021. In 2007, he was named Professional of the Year by the El Paso Society for Human Resources Management. Chambers USA recognized him as “an increasing prominent figure in the market and a stalwart of the practice and of the El Paso labor and employment bar who excels in preventive counseling and litigation. Mike currently serves as President of the El Paso Downtown Management District and Board Chair of the El Paso Hispanic Chamber of Commerce. He is a former President of El Paso Pro Musica and former member of the Boards of Directors of the YMCA of Greater El Paso and the El Paso Central Business Association and a member of Leadership El Paso Class V. He serves as General Counsel of El Paso Country Club.
